Consular process

The consular process is a crucial path for individuals seeking to immigrate to the United States from abroad. In contrast to adjustment of status, which applies to individuals already within the U.S., the consular process is designed for applicants who must complete their immigration applications from outside the country.

At its core, the consular process involves three main stages: petition approval, consular processing, and issuance of a visa. First, a family member or employer in the United States must file a petition with U.S. Citizenship and Immigration Services (USCIS) on behalf of the foreign applicant. Once USCIS approves this petition, the case is forwarded to the National Visa Center (NVC), which acts as a bridge between USCIS and the U.S. consulate or embassy in the applicant’s country. The NVC facilitates document collection, fee payments, and interview scheduling, ensuring that applicants have the necessary paperwork for their consular appointment.

When the applicant attends their consular interview, they undergo a thorough review by a consular officer. This interview assesses their eligibility and admissibility under U.S. immigration laws. Applicants are advised to come fully prepared, as the consulate will scrutinize their application for completeness and accuracy, and may ask for further documentation or clarification. If approved, the applicant receives an immigrant visa, allowing them to travel to the United States. Upon arrival, they will be admitted as a lawful permanent resident, marking the culmination of their immigration journey.
